    Im currently in my 8th year H1 extension. I will file for my 9th year extension ( 1yr extension) and get it stamped in December. Then I will be outside the country for a year and will come back in next december'07. At that time can i file an extension and get a 3 year extension since i have been out of the country for a year ? If my labor gets approved and 140 gets approved then i know i will be able to do it but if the labor is still stuck....

    Pictures are listed in required list of documents but they don't ask for them always. My wife went for stamping 4 months back and they just looked at marriage-certificate and my approved petition....that's it ! But I have seen CO's asking for pics.

    So it's a hit/miss kinda deal....

    Depicting "despair" using a photo and nothing else is tough. A final in one of my photoshop classes was to make a TIME magazine cover that depicted either "despair" or "hope". It was a lot harder to do that we all originally thought.


    This comes close but it could also be construed as sadness, anger, weariness, pain, etc.

    As I said, that's a very tough emotion to depict in a photo without any supporting text.

    Yes, your current & past paystubs(Primary H1B holder) are needed to grant H4 Visa for spouse. H4 is a dependent visa and is granted based on the primary H1B visa holder's status. In case of transfer from H1B to H4, his paystubs are also needed to proove that he was in legal status during this time.

    If I apply for my husband's H4, do we need to show my past paystubs?

    Or will my husband's H1 information, like his employment verification, I-94, and H1B approval be enough?

    Please advise....thanks!

    This evening, news media outlets are reporting that Solicitor General Elena Kagan will be the nominee to replace Justice John Paul Stevens on the US Supreme Court. Kagan was asked last summer by the Supreme Court to opine on whether the high court should hear a challenge to the constitutionality of the 2007 Arizona employer immigration sanctions law. Kagan has so far not provided an answer and she'll no doubt be asked about this. She'll also likely be asked about the new Arizona law.

    I am working on H1B visa as full time employee (Business Analyst) for a global manufacturing company. After going throughforums I understand that as consulting employees need client letters, similarly full time employees need in house project documentation for visa stamping. I work in IT department of my company where we maintain applications and provide production support and there is no specific project that I am working on. Should full time employees must have in house project documentation for visa stamping? Will I have any problem if I tell VO that I provide production support and am not working on a specific 1 project?

    Hello,

    I run an IT business from here in Canada and make about US$ 80K/Year. I am now thinking to move to USA and was wondering how I could use my company to benefit and help me with that.

    Is it better to move the company to US or is it better to open a subsidiary in USA? Also what are the minimum requirements to be successful in the immigration visa? Do I need to declare a minimum amount to the Canadian government etc.., that will be a proof for my company etc..?

    I run the company myself with my common-law-partner. We do everything, including sending bills, invoices etc..

    Thank you for any advice.

    One explanation for all this is that politicians are acting against the will of their compromise-loving constituents. Another is that Republicans and Democrats are simply being good representatives. We think the evidence supports the second interpretation.

    The Cooperative Congressional Election Study (CCES) surveyed more than 24,000 Americans who voted in 2006. The Internet-based survey compiled by researchers at 30 universities produced a sample that almost perfectly matched the national House election results: 54 percent of the respondents reported voting for a Democrat, while 46 percent said they voted for a Republican. The demographic characteristics of the voters surveyed also closely matched those in the 2006 national exit poll. If anything, the CCES respondents claimed they were more "independent" than those in the exit poll.

    The CCES survey asked about 14 national issues: the war in Iraq (the invasion and the troops), abortion (and partial birth abortion), stem cell research, global warming, health insurance, immigration, the minimum wage, liberalism and conservatism, same-sex marriage, privatizing Social Security, affirmative action, and capital gains taxes. Not surprisingly, some of the largest differences between Democrats and Republicans were over the Iraq war. Fully 85 percent of those who voted for Democratic House candidates felt that it had been a mistake to invade Iraq, compared with only 18 percent of voters who cast ballots for Republicans.

    When we combined voters' answers to the 14 issue questions to form a liberal-conservative scale (answers were divided into five equivalent categories based on overall liberalism vs. conservatism), 86 percent of Democratic voters were on the liberal side of the scale while 80 percent of Republican voters were on the conservative side. Only 10 percent of all voters were in the center. The visual representation of the nation's voters isn't a nicely shaped bell, with most voters in the moderate middle. It's a sharp V.

    The evidence from this survey isn't surprising; nor are the findings new. For the past three decades, the major parties and the electorate have grown more divided -- in what they think, where they live and how they vote. It may be comforting to believe our problems could be solved if only those vile politicians in Washington would learn to get along. The source of the country's division, however, is nestled much closer to home.

    When Senate Majority Leader Harry Reid picked up his ball and went home after his staged all-night session last week, he saved from possible embarrassment one of the least regular members of his Democratic caucus: Sen. Ben Nelson of Nebraska. Reform Republican Tom Coburn had ready an amendment to the defense authorization bill removing Nelson's earmark funding a Nebraska-based company whose officials include Nelson's son. Such an effort became impossible when Reid pulled the bill.

    That Reid's action had this effect was mere coincidence. He knew that Sen. Carl Levin's amendment to the defense bill mandating a troop withdrawal from Iraq would fall short of the 60 votes needed to cut off debate, and Reid planned from the start to pull the bill after the all-night session, designed to satisfy antiwar zealots, was completed. But Reid is also working behind the scenes with House Speaker Nancy Pelosi to undermine earmark transparency and prevent open debate on spending proposals such as Nelson's.

    These antics fit the continuing decline of the Senate, including an unwritten rules change requiring 60 votes to pass any meaningful bill. When I arrived on Capitol Hill 50 years ago, Majority Leader Lyndon Johnson (like Reid today) had a slim Democratic majority and faced a Republican president, but he was not burdened with the 60-vote rule. While Johnson did use chicanery, Reid resorts to brute force that shatters the Senate's facade of civilized discourse. Reid is plotting to strip anti-earmark transparency from the final version of ethics legislation passed by the Senate and House, with tacit support from Republican senators and the GOP leadership.

    At stake is the fate of Coburn's "Reid amendment," previously passed by the Senate and so called because it would bar earmarks benefiting a senator's family members such as Reid's four lobbyist sons and son-in-law. Nelson's current $7.5 million earmark for software helps 21st Century Systems Inc. (21CSI), which employs the senator's son, Patrick Nelson, as its marketing director. The company gets 80 percent of its funds from federal grants, mostly through earmarks. With nine offices scattered among states represented by appropriators in Congress, the company has in recent years spent $1.1 million to lobby Congress and $160,000 in congressional campaign contributions. "As of April," the Omaha World-Herald reported, "only one piece of [the company's] software has been used -- to help guard a single Marine camp in Iraq -- and it was no longer in use."

    In requesting the 21CSI earmark, Nelson did not disclose his son's employment. "There's no requirement that he disclose that," a Nelson spokesman told this column. "But frankly, in this case, we didn't disclose it because it's so public." An April 24 letter from Levin giving senators instructions on how to request an earmark made no mention of the "Reid amendment" that had been passed by the Senate three months earlier but that required only certification that no senator's spouse would benefit from an earmark. Inclusion of Nelson's son, however, would be required if the ethics bill provision passes.

    When the defense authorization bill came up last week, Coburn prepared amendments to eliminate the Nelson earmark and the most notorious earmark pending in Congress: Democratic Rep. John Murtha's proposed $23 million for the National Drug Intelligence Center in his Pennsylvania district. Reid's plan to satisfy antiwar activists with an all-night debate averted debate, for now, on those two earmarks.

    Reid, the soft-spoken trial lawyer from Searchlight, Nev., has tended to suppress free expression in the World's Greatest Deliberative Body in his tumultuous 6 1/2 months as majority leader. Last week, he cut off an attempt by Sen. Arlen Specter, the veteran moderate Republican, to respond to him with an abruptness that I had not witnessed in a half-century of Senate watching. When Specter finally got the floor, he declared: "Nothing is done here until the majority leader decides to exercise his power to keep the Senate in all night on a meaningless, insulting session. . . . Last night's performance made us the laughingstock of the world." It may get worse if plans to eviscerate ethics legislation are pursued.

    I am working on OPT and my spouse is filing AOS/EAD/AP. What happens till it is approved? Can I work?

    yes, you can work on OPT till EAD comes. Once EAD comes, just file a new I-9 with EAD and continue working.

    Remember, in OPT, you do not have to pay social security tax. Once you switch to EAD, you have to pay social security tax.

    During the month of June, when the dates were announced in July Bulletin, that all the EB are CURRENT, we were prepared to apply. But my wife has some health issues and after the July2nd news, she left to India for Treatment. As per doctors now she can't travel till end of August. My questions are:
    1) If I apply for my I-485, at what stage in I-485 can i add my wife as a dependant so she also gets her EAD and AP along with me?
    2) Somewhere on the internet, I have seen that I can apply for my spouse's Green card 180 days after my Green card approval also as long as we were married before my I-485 was applied. Is this true? Can someone please confirm?
    3) Curretnly my wife is on H-1B and she still has 5more years on it. Can I apply for her I-485 once the dates open up again?

    Please advice as what are the best options?

    My h1-b is expiring in decemeber, i applied for renewal 4 months back but it is stuck in security check. I can apply for 485 as my 140 is approved.
    1. if i apply for 485, then EAD can also go thur sec check?
    2. after 240 days if EAD is not available what are my options?
    3. I am planing to get married but cant bring wife on h4 as my h1 is not current, what are my options? if my 485 get approved or i use my EAD i wouldnt be able to bring her?

    I was wondering if this recession could turn out to be a silver lining for those of EB2-I,C who manage to survive it. Come to think of it, with all these job losses theres bound to be a downturn in hiring - resulting in lesser number of EB1 and EB2 ROW applications. This means more could overflow to EB2 I and eventually EB3 (I,C and ROW) survivors will benefit to.

    Although we also need to remember that the H1B quota will still get filled up on Apr 1 - recession or not. So don't really know how this would turn out.

    What are your opinions folks?
