I recently got married. My is currently on H1 and is currently in US. Will my wife's I-485 be returned as the priority date is not current I am in EB3 priority date is Mar 2002. Anybody in similar situation as me..please post...
you can not file I-485 for your wife till PD becomes current.
I'm in the same boat. you need to make sure your wife maintains her visa status. Since she is on H1 she should file a labor to make use of 7th year.

We are indian nationals living in the US - I have an H1-B visa with visa stamp valid till 05/2010 and my wife is on H4 - she has a valid 797 but does not have a visa stamp yet

Yes, this is very common. BTW once IO at POE made an error and give I-94 till 3 years when my I-797 was expiring in less than a year. Immediately came back to him and brought to his attention and he corrected it.

I am planning to use AC21 to change employers. I signed G28 to allow the attorney for my current employer to represent me before USCIS. Since I signed G28, is it possible for my current employer to withdraw my I-485 application?

- Was the I-134 part of your I-485 application, or was it part of your dependent's?
I am asking this because there is no instruction regarding such an affidavit in the Initial evidence section of the I-485.

Does anyone know if there would be some kind of record about
when and how many times we have spoken to the IIO.
Like will a IIO be able to look at one's receipt# and say if they have spoken to an IIO earlier that day or whenever that is?

What I understand is that, your spouse can apply for H1, but not "change of status" while on EAD/adjustee. The establishment of H1 status for your spouse is possible only via an entry using H1 visa.
So your spouse can wait in USA for the H1 approval notice and then travel outside USA for consular processing.
Anyway, it may not worth all this pain, since she can continue using EAD.

Hi,
My U.S. born son is travelling with my friends from India to USA. He had gone to India for summer vacation. Would anybody have any sample letter for addressing to immigration authorities that we authorize his travel along with my friend.

US born child is citizen by birth and has RIGHT to enter United States. Immigration officials cant deny him the right to enter USA.
A simple letter saying that you have authorised your friend to accompany your child (minor) for the travel. The letter should have your contact address, cell etc

I suppose you are doing consular processing? Right? Well, when the consulate is aware that your PD is about to be current, and if all other tasks are completed, they should send you packet 60-90 days in advance of your interview.

The new fee structure goes into effect Aug 17.
I vaguely remember reading an anecdote that there is no need to pay yearly renewal fees in the new fee structure. (Am I right?) Please share your views.

OK...I just got an email from my Attorney. It is indeed what she thought. She received our receipts today from the CSC. The receipts have a receipt date of July 23rd and a notice date of September 19th. As to why the CSC sent out the other notice transferring the case back to NSC to me only and not the Attorney...that is a mystery. She plans to speak to our State Senator and hopefully get some answers.

Last October I hired a lawyer for an AOS ( I-485 ) and the I-130 and I-131 forms.
Obviously I did it because I did not have any knowledge about immigration matters.
In Novembre 2007 he did contact me telling me I needed the I-765 form to legally work in the country, so I did fill the form sending it in his office by mail.
He told me he sent the form in the first week of December 2007.
Ok now this is the situation :
I never get by mail the notice of action about the form I-765 and what concern me the most is that I still did not get the permit to work.
I periodically check the processing time cases from the USCIS' website, and I have seen that USCIS (NEW YORK area ) already processed the I-765 forms for the complete month of December, does anyone know if Uscis is having problem processing EADs....I am really worried that something did not go through... probably it's just normal to have so many questions but recently I think about that all the time.
Oh guys one more thing...I paid this lawyer thousand and thousand of dollars.
I realized reading the USCIS website that if you fill the form I-485 you are not required to pay the $ 340 fee for the I-765 form . Last November he asked me to send him a check for the EAD fee. When I told him that last time i spoke with him by phone he said he did know that , then he told me that he just had moved from his old office to a new one so my case was in storage, in storage ?? My case is still pending and he put it in storage, i am so disappointed ...unbelievable this lack of professionality.
I should have do it by myself at least now I would have money to buy a nice used car.

Some where I read that there is no fee for renewal of AP. I am a Jul 07 filer and am not sure about this. Further already applied last year for Advance parole and traveled once. it got expired last month. I am applying for a new one again. So just wanted to know if I need to pay the fees $305.
So my questions are:
Does July 07 filers need to send the cheque for $305 for AP renewal. (My I 485 Reciept Date is Aug 2007)
Should we also include Biometric fee of $80?
And how much time approx is it taking these days for AP?
